Appeal of Espinet (No. 16,212): Standard for School Co-Locations

The Commissioner’s Decision in Espinet (No. 16,212) demonstrates the importance of the Mulgrew case in establishing a strict standard for EIS specificity. At the same time, the Decision permits lax adherence to fair public notice and hearing standards by the DOE. Co-locations will be less attractive to charter students but remain financially advantageous for charter school operators.
